Terms of Service

The rules for using TAM Freight as a shipper or a driver, in plain language.

Last updated October 25, 2026

01About these terms

These Terms of Service form an agreement between you and TAM Freight (“we”, “us”). They apply to the TAM Freight website at www.tamfreight.com and the application at app.tamfreight.com (together, the “Service”). By creating an account or using the Service you agree to them. If you do not agree, do not use the Service.

Drivers are also bound by the Driver Agreement, and everyone must follow the Acceptable Use Policy, Refunds & Disputes policy and Privacy Policy. These documents are part of this agreement.

You must be at least 18 years old and able to enter a binding contract. If you use the Service for an organization, you confirm you may bind it to these terms.

02What TAM Freight does

TAM Freight is a platform that connects shippers who need freight moved locally with independent drivers. We provide the tools to post and accept loads, verify drivers, record proof of delivery, hold and release payment, and resolve disputes.

We are not a carrier. We do not take possession of freight, and we do not employ drivers. The contract to carry a load is between the shipper and the driver, on the terms posted on the load and these terms. Where we describe a driver as “verified”, that means the driver completed our identity review at a point in time. It is not a guarantee of conduct, competence, insurance or licensing.

03Accounts and security

You must give accurate information and keep it current. You are responsible for activity under your account and for keeping your password confidential. Tell us immediately at support@tamfreight.com if you suspect unauthorized access.

One person may hold one account of each type. You may not share an account or let another person use your TAM-ID.

We may suspend or close an account, refuse a load or withhold a payout if we reasonably believe there is fraud, a safety risk, a breach of these terms or a legal requirement to do so.

04Shippers

When you post a load you must describe it accurately, including its nature, weight, size, handling and temperature requirements, and the pickup and drop-off addresses. You must have the right to ship the items, and they must comply with the Acceptable Use Policy.

The delivery fee you set is reserved from your wallet when you post the load or when a driver accepts it, as you choose. The reserved amount is not available for other loads until the load settles or is cancelled.

When a driver marks a delivery complete, you have 24 hours to confirm it or open a dispute. If you do neither, and no dispute is open, the delivery is confirmed automatically and payment is released. You can cancel a load that has not yet been accepted by a driver.

05Wallet, fees and payment

Shippers add money to a TAM Freight wallet by card, processed by Stripe. Balances are recorded in US dollars and do not earn interest. A wallet is a record of funds held for use on the Service; it is not a bank account and is not insured by any deposit-insurance scheme.

Each completed delivery is settled as follows: 88% of the delivery fee is credited to the driver and 12% is retained by TAM Freight as its platform fee. We may change this split for future loads with at least 30 days’ notice.

Drivers can request a payout of their available balance. Payouts are reviewed and sent manually, so they are not instant. Amounts in a payout request leave your wallet when you submit it and return if we reject the request. We may delay or refuse a payout for security, compliance or dispute reasons.

You are responsible for any taxes that apply to your use of the Service. We do not provide tax advice.

06Proof of delivery

Drivers must record a delivery photo, the name of the person who received the freight and the recipient’s signature before a delivery can be completed. These records, with the timestamps of each status change, are stored with the load and may be used to resolve disputes. Shippers and drivers consent to this recording.

07Disputes

If a delivery has a problem, the shipper can open a dispute before the delivery settles. While a dispute is open the funds stay reserved. We review the proof of delivery and what each party tells us, then either pay the driver or release the funds back to the shipper. Our decision on how the reserved funds are released is final within the Service, but it does not limit any legal rights you have against the other party. See the Refunds & Disputes policy for details.

08Acceptable use

You agree not to misuse the Service. In particular you will not:

  • ship items prohibited by our Acceptable Use Policy or by law;
  • impersonate another person or misrepresent your identity, vehicle or credentials;
  • upload false, forged or unlawful proof of delivery;
  • interfere with or probe the Service, or attempt to access data that is not yours;
  • use the Service to harass, defraud or endanger anyone;
  • take a load outside the platform to avoid fees after being introduced through it.

09Risk, warranties and liability

The Service is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties not expressly stated here, including fitness for a particular purpose and uninterrupted or error-free operation.

Because freight is carried by independent drivers, loss of or damage to freight, and any delay, is a matter between the shipper and the driver. Shippers should insure valuable or irreplaceable items. We are not liable for losses arising from the conduct of shippers, drivers or recipients.

To the fullest extent permitted by law, our total liability to you for any claim arising from the Service is limited to the platform fees you paid us in the three months before the claim arose. We are not liable for indirect, incidental or consequential losses, or for lost profits, data or goodwill. Nothing in these terms excludes liability that cannot be excluded by law, including for fraud or for death or personal injury caused by our negligence.

You agree to indemnify us against claims and costs arising from your breach of these terms, the freight you ship or the way you carry it.

10Our content and your content

We own the Service, including its software, design, the TAM Freight name and logo. We grant you a limited, revocable, non-transferable licence to use the Service as these terms allow.

You keep ownership of the content you submit, such as load descriptions and photos. You grant us a licence to host, display and use that content to operate the Service, resolve disputes and meet legal obligations.

11Changes and ending

We may update these terms. When we make a material change we will notify you by email or in the app before it takes effect. If you keep using the Service after the effective date, you accept the updated terms.

You can close your account at any time by contacting support, once open loads are settled and your balance is withdrawn. Sections that by their nature should continue after termination, including payment obligations, liability and dispute terms, will continue.

12Governing law and contact

These terms are governed by the laws of the jurisdiction in which TAM Freight is established, except where consumer protection law gives you the right to rely on the law of your home jurisdiction.
